These terms and conditions govern your use of the web site and any contract between you and MG Sun Control Systems for the purchase of goods. By ordering goods from the Conservatory-inserts web site, you agree to be bound by these terms and conditions and agree that they constitute a Legally binding contract between you and MG Sun Control Systems.
"www.conservatory-inserts co.uk" means "MG Sun Control Systems", HQ at: Unit 5b, Anchor Road Industrial Estate, 15, Anchor Road, Clacton-on-Sea, Essex, CO15 1HP.
“HQ” means: our Head Office.
"you", means any user of the web site
“we / us” means www.conservatory-inserts.co.uk
"goods" means Solar Inserts and Window Film, available on the web site
"Agreement" means these terms & conditions.
"working day" means Monday through Friday inclusive, except for public & bank holidays
"web site" means the web site accessible at the url http://www.conservatory-inserts.co.uk
"P&P" means postage and packing.
2.1 You agree that all communications between MG Sun Control Systems and you, can be made by email.
2.2 Unless otherwise expressly stated, any notices sent by email pursuant to the terms of this Agreement shall be deemed to have been made upon such email being sent.
2.3 Without prejudice to your rights and MG Sun Control Systems obligations under relevant data protection laws, any personal information you send to www.conservatory-inserts.co.uk via email is done so at your own risk.
3.1 Your use of the web site is subject to our conditions of use and disclaimer (to view click on this link).
3.2 MG Sun Control Systems reserves the right to withdraw the web site, any information contained in the web site, and any goods offered for sale on the web site, at any time in part or in whole without any prior notice.
3.3 You agree not to use the web site in any way which may cause degradation in performance of the web site or conservatory-inserts.co.uk computer systems or interruption to the web site’s or conservatory-inserts.co.uk systems operation.
3.4 conservatory-inserts.co.uk reserves the right to investigate your use of the web site for any reason whatsoever and report any suspected unlawful use of the site or fraudulent use of any credit or debit card or other payment method to relevant law enforcement authorities.
3.5 You are responsible for ensuring that use of this web site or any part of it, is permissible in your jurisdiction. You agree that conservatory-inserts.co.uk shall not be liable to you to the extent that any laws in your jurisdiction render conservatory-inserts.co.uk performance of its obligations under this Agreement unlawful.
3.6 You agree to fully indemnify conservatory-inserts.co.uk for any claims, damages and costs, including legal fees, suffered by conservatory-inserts.co.uk arising out of any misuse of the web site by you or any user of your computer equipment, whether authorised by you or not, or any misuse of the web site or your conservatory-inserts.co.uk account information by any other user (except to the extent that such misuse arises from unlawful disclosure of your account information by conservatory-inserts.co.uk to third parties).
3.7 You must be 18 years or older to use the web site and purchase goods offered for sale on the web site.
4.1 An order placed by you through this web site will be considered as an offer to purchase goods from conservatory-inserts.co.uk. Until your offer has been accepted in accordance with the terms of this Agreement, no contract for the sale of goods exists between you and conservatory-inserts.co.uk and for the avoidance of doubt, prior to such acceptance, conservatory-inserts.co.uk shall have no obligation to deliver any goods pursuant to your order.
4.2 On receipt of your order conservatory-inserts.co.uk shall issue a confirmation email (“Confirmation Notice”) to confirm receipt of your order.
4.3 conservatory-inserts.co.uk reserves the right to refuse to accept an offer to purchase goods for any reason whatsoever.
5.1 You may cancel an order, or part order, at any time after you have placed it and before a contract for the sale of goods is in effect between you and conservatory-inserts.co.uk in accordance with the terms of this Agreement.
5.2 You must communicate this cancellation by email (sent from you to us) to cancel@conservatory-inserts.co.uk, or in writing (by letter sent to conservatory-inserts.co.uk HQ address) and you must specify the order number(s) to which the cancellation relates, full details of all items to be cancelled and your current name and address.
5.3 conservatory-inserts.co.uk shall endeavour to review and act upon your cancellation request as soon as practicable, however it may take up to 28 days from the time conservatory-inserts.co.uk receives your request until the time conservatory-inserts.co.uk reads and acts upon your request. If conservatory-inserts.co.uk does not process your cancellation request until after acceptance of your offer, conservatory-inserts.co.uk will act upon your request and will confirm cancellation of the contract as soon as practicable thereafter.
6.1 A contract between you and conservatory-inserts.co.uk for the purchase of goods will come into effect when all of the following conditions have been satisfied:
6.1.1 you place an order through the web site.
6.1.2 your order is not rejected by conservatory-inserts.co.uk
6.1.3 an acceptance email (“Acceptance Notice”) is sent to you to confirm acceptance of your offer to purchase goods and to confirm receipt of payment for the goods. For the purpose of this clause, your offer will be deemed to be accepted at the point when conservatory-inserts.co.uk sends the Acceptance Notice.
6.2 The Acceptance Notice will be sent to you at the email address specified by you on your customer account and / or our online shopping cart completed by you at the relevant time. It is your responsibility to review the Acceptance Notice and advise conservatory-inserts.co.uk of any changes to any information provided by you. You should keep a hard copy of the Acceptance Notice. A copy can be provided to you should you lose the original. The copy will be sent to you via email only.
6.3 conservatory-inserts.co.uk shall arrange delivery of the goods to the address specified by you in your order.
6.4 You pay in advance and in full for the goods prior to them being dispatched to you. conservatory-inserts.co.uk will charge your credit / debit card via the automatic shopping cart on the Website. 6.5 Title of goods will pass to you at the point that conservatory-inserts.co.uk has charged your payment card and issued you the Acceptance Notice; or, when other payment methods are used, (subject to our prior agreement) funds are credited to conservatory-inserts.co.uk account.
7.1 you may not withdraw from a contract to purchase goods if you are buying the goods for business purposes or if they are intended for use or used for anything other than private or personal use.
7.2 You may withdraw from your contract for the purchase of goods from conservatory-inserts.co.uk from the time it is made up to and including 7 working days from the day you have received your goods.
7.3 conservatory-inserts.co.uk will refund the full amount you paid for the goods within 30 days of your cancellation notice provided that you comply with your obligations in Clause 7.4 and 7.5 below. conservatory-inserts.co.uk will not provide a refund if any packaging or seals on the goods have been broken.
7.4 To withdraw from a contract for the purchase of goods you must communicate this to conservatory-inserts.co.uk by email (sent from you ) to: cancel@conservatory-inserts.co.uk, or in writing (by letter sent to conservatory-inserts.co.uk head office in Clacton) and you must specify the order number(s) to which the cancellation relates and full details of all items in respect of which you wish to cancel.
7.5 Once conservatory-inserts.co.uk has read and accepted your request to withdraw from the contract, conservatory-inserts.co.uk will issue you with a returns authorisation and other instructions necessary for you to return the goods to conservatory-inserts.co.uk (in the event that the goods have already been dispatched or delivered to you). You agree to comply with all instructions and to take reasonable care to ensure that the goods are received by conservatory-inserts.co.uk in undamaged condition. Conservatory-inserts.co.uk will not refund you if you do not take reasonable care to ensure that goods arrive undamaged and this results in non-delivery or damage to returned goods.
7.6 You will be responsible for bearing the cost of returning any goods to us where you cancel the contract in accordance with this clause 7 of the Agreement.
8.1 Conservatory-inserts.co.uk reserves the right to change any prices that may be listed now, or in the future, on the web site without prior notice.
8.2 The price you pay for goods is the amount as shown on our shopping cart checkout at the time that you input your detailed information, and the order you place for the goods, is subject always to your compliance with our terms and conditions mentioned in such email and the conditions stated herein, and includes VAT where applicable.
8.3 A separate P&P charge may apply to goods and this will be shown on the web site. The P&P charge shown is for the UK only. If you purchase goods for delivery to a country other than the UK, then you must phone: 01255 688847 for instructions before proceeding to order.
8.4 Conservatory-inserts.co.uk accepts payment by credit and debit card only, through the Website.( see condition 6.4 above, for other methods outside the Website )
9.1 Delivery of goods ordered by you will be made within 30 days after conservatory-inserts.co.uk acceptance of your offer by way of the Acceptance Notice. Conservatory-inserts.co.uk may at its discretion, deliver the goods in separate consignments.
9.2 If conservatory-inserts.co.uk judges that it will be unable to deliver the goods to you within the prescribed period, you will receive notification of the same and conservatory-inserts.co.uk will provide you with an alternative delivery date.
9.3 If you do not receive the goods within 30 days of the Acceptance Notice, you must notify conservatory-inserts.co.uk by email (to goods@conservatory-inserts.co.uk) within [7] days after the due delivery date.
9.4 If you do not receive the goods within the time limits set out above, and you notify us as required, we will refund the amount you paid for the goods, unless we agree with you to resend the goods.
9.5 conservatory-inserts.co.uk shall not be liable for any duties, customs or other taxes that may be imposed by an authority in any country outside the EU.
10.1 conservatory-inserts.co.uk will replace any goods returned by you which when delivered, were either damaged or did not conform to the specification that you ordered and was stated on the web site or on our quotation email, whichever applicable, provided you notify conservatory-inserts.co.uk in writing within 14 days of delivery of the goods to the address specified on your order. You must send any goods back (and pay for the appropriate P&P ) by recorded delivery if over £35 or if under £35, please obtain a free certificate of posting from the post office. We cannot be held responsible for items missing in the post without proof of posting.
10.2 Goods will only be replaced by us after the original goods are returned. Conservatory-inserts.co.uk will not be liable for any goods that are not returned by you as required. conservatory-inserts.co.uk will refund the amount paid by you for the original goods. You will pay the new price for the replacement goods at the price stated in the website calculator, or calculated by us via a separately requested email, should the need arise. Conservatory-inserts.co.uk will refund the reasonable costs associated with returning faulty or incorrect goods to conservatory-inserts.co.uk.
11.1 You are required to make all reasonable efforts to provide us with the correct details and measurements. If you are not sure of these details and measurements, you should call us on: 01255 688847 for assistance in this matter.
11.2 Should failure on your part to comply with 11.1 above, result in incorrectly sized, or incorrect amounts of, Solar Inserts & / or incorrect installation fitting kits being sent by us:
Then:
A)We will make all reasonable efforts to replace these incorrect item/s to you, after:
B)you provide us with the correct details
C)you first return these incorrect item/s at your expense, after notifying us within 7 days of original receipt of such incorrect item/s.
D)You comply with all other terms and conditions contained in the Agreement, where applicable.
In these circumstances, you will agree to conservatory-inserts.co.uk charging your credit/debit card, the difference between the original amount charged, and any additional amounts that would have been payable by you under the automatic shopping cart system on the website, in addition to our P&P charges for the replacement items. Any refunds that you would be entitled to under these circumstances, will be refunded to your credit/debit card, or offset against other payable amounts by you, at our sole discression.
11.3 Your failure under conditions 11.1 and 11.2 above, does not entitle you to cancel the contract (unless by our prior agreement, at our total discression), nor will it entitle you to a refund of original monies owing, unless:
Your conservatory roof is not suitable for Solar Inserts, it being of a glass or corrugated plastic construction, or of any other type of material this is not compatible with our Solar Inserts; in which circumstance, they are not fit for your purpose, and a full refund will be allowed, minus our £50.00 cancellation fee.
12.1 If, after completing your DIY installation of our Solar Inserts, there are one or more reels of our inserts left over, then conservatory-inserts.co.uk will refund you 80% of the pro-rata original cost ( after first deducting the £9.99 P&P ) that you paid; subject to:
The Solar Insert reels are unused, still sealed and undamaged.
That any costs incurred in these returns are paid by you.
No refunds will be allowed for any items of the Installation kit.
You are required to ensure the solar inserts are sufficiently protected when packaged so as not to cause them damage in transit (see condition 10)
Only after the safe return to us of such Solar Inserts, will a refund by us, be sent you.
12.2 No refunds will be allowed on any commercial / trade purchase/s of our Solar Inserts. ( also see condition 7.1 ).
13.1 Conservatory-inserts.co.uk confirms that in relation to any goods purchased from the web site:
(a) Conservatory-inserts.co.uk has the right to sell the goods to you;
(b) The goods will correspond with the description given on the web site;
and
(c) The goods will be of satisfactory quality.
13.2 Conservatory-inserts.co.uk excludes all other express or implied terms, conditions, warranties, representations or endorsements with regards to any goods. conservatory-inserts.co.uk accepts no liability for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business (whether direct or indirect) however caused or whether foreseeable or not, arising from your purchase of goods on the web site.
13.3 Conservatory-inserts.co.uk total liability to you under any contract for the purchase of goods or otherwise under this Agreement will be limited to the amount paid by you for any goods purchased.
13.4 Conservatory-inserts.co.uk will not be responsible for any loss or damages incurred by unauthorised use of your payment card on the web site. Conservatory-inserts.co.uk is not responsible for notifying your card issuer or any law enforcement authority in these instances.
13.5 The limitations and exclusions in this clause do not affect your statutory rights and only apply to the extent permitted by applicable law.
14.1 Conservatory-inserts.co.uk shall not be liable for any failure to deliver or delay in delivery of the goods, or damage to goods delivered, arising from circumstances beyond conservatory-inserts.co.uk reasonable control.
15.1 The above represents the entire terms and conditions relating to your use of the web site to order goods and the supply of goods to you. These terms and conditions can not be varied except as specified above.
15.2 These terms and conditions can only be varied in writing when signed by a director of conservatory-insert.co.uk. No additional terms or conditions requested by and communicated in any way by you will form part of the contract whether accepted or not by an employee of conservatory-inserts.co.uk. No employee of conservatory-inserts.co.uk can alter the terms and conditions of this contract whether or not they confirm this to you in any way.
16.1 This Agreement and any contract for the purchase of goods shall be construed in accordance with and governed by the laws of England.
